This decision recommends granting a new 125-year lease to MDL Marinas Ltd as part of lease renewal negotiations as set out in the Executive report published for 24 March 2020, reference E/19/63.

That the Property Services Operations Manager, in consultation with the Legal and Democratic Services Operations Manager, be authorised to enter into a new 125-year lease, in accordance with the Heads of Terms appended to report E/19/63, subject to reasonable and minor amendment.

Reason for decision:

The Chief Executive has exercised the delegated authority granted to him by the Leader on 24th March to take decisions on any and all Executive functions in consultation with the Leader (or in his absence or unavailability, with the Deputy Leader) to ensure that the Council does not lose or delay the benefit of the negotiated settlement of a new  for a 125 year term which produces  increased  income for the Council and ends costly court proceedings.
