Purpose:

In order to meet the requirements of the regulations under article 24 of the Regulatory Reform (Fire Safety) Order 2005 (Fire Safety Order), which will become law on 23 January 2023, invitations to quote were issued by Michael Dyson Associates, on behalf of the Council. Five Fire Engineers were asked to provide a quotation to undertake a PAS9980 Risk Assessment of the cladding at Cumberland Towers. A single quote was received from M10 Fire Consultancy Ltd in the sum of £10,502.50, which was based on price alone.

 

Due to the deadline of meeting a new legislative requirement by 23 January 2023 and the market demand for Fire Engineers due to new legislation, it has been decided to exempt this decision from the Council’s Contract Standing Orders and to place an order for this work with M10 Fire Consultancy Ltd.

 

If the exemption from contract standing orders had not been made, the Council may not have been able to comply with new legal requirements, under the Fire Regulatory Reform Order, by the deadline. The cost will be met from existing budgets.

Decision:

To exempt this decision from the Council’s Contract Standing Orders and to place an order for the cladding risk assessment work with M10 Fire Consultancy Ltd.

 

Reason:

To ensure the work required by new legislation is completed by the 23 January 2023 deadline to comply with the new legal requirements.
