The Development Management Team Leader presented the report illustrated by drawings and photographs.  A site visit was undertaken by Members of the Committee on 23 April 2019.

 

The report was updated with 2 late representations received from Mr R Bell, 8 Henley Road, received 17.4.19, and Mr Peter Gray, Chair of Friends of Christchurch Park, 15 Elsmere Road, received 18.4.19. Issues raised included:-

 

-           Comments regarding tree cover within Christchurch Park.

-           Proposal would be visible from the Park and would result in harm.

-           Concern with regards to car parking to the rear and loss of biodiversity.

 

The report was also updated with a late late representation received from Neil Ward (Planning Consultant) on behalf of No.4 Park Road, received 23.4.19. Issues raised included:-

 

-           Commencement of development relating to IP/07/00118/FUL.

-           The ‘fall back’ position.

-           Impact on non-designated Heritage Assets.

-           Impact upon trees.

-           Impact upon amenity.

-           Housing requirements.

-           Seeking deferment so issues could be addressed.

 

Paragraph 5.48 of the report was corrected to reflect that the distance between the boundary with 4 Park Road and the eastern elevation of the extension was a minimum of 13.4 metres, not 7 metres.

 

Mr Martin Last spoke on behalf of the applicant in support of the application:

 

-           Permission was granted in 2007 for conversion and extension.

-           Proposal retained 14 flats with further modest extension.

-           Detailed design and materials respect the original dwelling.

-           Proposal included parking to front and rear as well as cycle and bin storage.

-           A ‘no mechanical dig’ method would be employed within the root protection areas of the protected trees.

-           Additional landscaping was proposed with beech hedge and trees.

-           Existing vehicular access onto Henley Road to be stopped up.

-           Concerns raised by Conservation Officer regarding car parking; however, this was not behind dwelling and green space would be retained as linkage to park.

-           Council’s Tree Officer confirmed impact upon protected sweet chestnut tree could be mitigated by condition.

-           Conservation Panel confirmed extension was low key.

-           Parking to the rear would not set a precedent.

-           Proposals included the retention of a large element of the rear garden.

-           Proposals delivered much needed housing for the Borough.

-           No impact upon heritage assets.

-           Scale and bulk of extension was acceptable.

-           Impact on drainage and biodiversity was acceptable.

-           Proposals would result in no increase in parking on Henley Road.

-           There would be no noise and disturbance to neighbouring properties, and a construction management plan could be agreed by condition.

-           Proposals would not adversely affect protected trees.

-           Application needed to be considered on its own merits.

-           Conditions proposed were acceptable.

-           Good use of a large dwelling.

The Development Management Team Leader presented the report illustrated by drawings and photographs.

 

Ms Vicky Cairney, Programme Director for YMCA Trinity Group, spoke in support of the proposals:

 

-           Government grant received in March 2017 to increase childcare provision.

-           144 space deficiency in Westgate ward.

-           Current childcare provision opened in April 2018.

-           Currently 27 children on the roll, 10 new starters this week.

-           Proposal would allow local need to be met.

-           Most parents lived locally and would therefore walk to the site.

-           Site already has cycle storage facilities.

-           Previous additional cycle storage facility refused on conservation grounds.

-           Staff not allocated parking spaces within site.

-           Proposal would not lead to creeping industrialisation.

-           Proposal would meet the needs of the community.

 

RESOLVED:

 

Grant planning permission upon condition that (briefly):-

 

1.         Development to be in accordance with plans.

2.         Loading, manoeuvring and parking of vehicles to be provided as per submitted drawing and thereafter retained and used for no other purposes.

3.         Provision of areas to be provided for powered two wheel vehicle provision, electric vehicle recharging infrastructure, and secure cycle storage to be submitted to and approved in writing by the Local Planning Authority.

4.         Provision of areas to be provided for storage of refuse/recycling bins as per submitted drawing and retained thereafter for no other purpose.

5.         Hours of operation restriction 8am to 6pm.

 

INFORMATIVES:

 

1.         Ipswich Borough Council supports the use of automatic sprinkler systems.

2.         It is an offence to carry out any works within the public highway, which includes a Public Right of Way, without the permission of the Highway Authority.

145.1.Councillor Knowles commented on the increasing number of problems arising from properties being converted to HMOs without the need for planning consent, with a further property being converted in Coniston Square, and asked whether the Council could make representations to the LGA to change this legislation.

145.2.The Planning and Development Operations Manager reported that no representations had been made; issues were being dealt with on a case-by-case basis and there was an enforcement process in place if works went beyond permitted development rights. In addition to this, the Council was progressing the introduction of an Article 4 Direction across the borough to remove permitted development rights relating to the change of use from dwelling houses to HMOs.

145.3.Councillor Rudkin commented that the enforcement report demonstrated good practice and this could be highlighted to the Planning Advisory Service (PAS) for inclusion in their bulletin.

145.4.Councillor Kreidewolf commented that the companies that performed building control inspections were not always local to the town being regulated.  Councillor Jones added that it was not usually possible to view the inspection reports of building control companies.

145.5.Councillor Gardiner commended Officers and Members of the Committee on the outcomes in the year-end Planning Performance report, highlighting that only one appeal had been allowed, which was in relation to an advertising hoarding. The Planning and Development Operations Manager congratulated Officers and highlighted cases where the deferral of applications by the Committee had enabled development issues to be addressed.

145.6.Councillor Gardiner passed on thanks to Officers and Members of the Committee for their support throughout the year. Councillor Gardiner added that this was Councillor Knowles last meeting as Vice-Chair as he would be standing down as a Councillor, and he thanked him for his support and invaluable experience over the years, especially in matters relating to retail and property.
