26.1.    Debbie Devine, Senior Licensing & Enforcement Officer, reported that Ipswich Borough Council had a statutory obligation to produce a Statement of Licensing Principles as part of the requirements of the Gambling Act 2005. This statement would set out the procedure for how applications for gambling premises would be processed by the Council and was the fifth statement to be produced thus far.

 

26.2.    The Officer advised that information which related to the residential makeup of Ipswich had not been included this time due to unavailable statistics at this time.  

 

26.3.    Once the draft statement had been approved by the Committee, this would be circulated to a number of different stakeholders and published on the Council’s website under ‘consultations’ so that the general public could view and submit comments. Once the consultation period had finished, the results of this would be considered by the Licensing & Regulatory Committee for approval and then considered by full Council ready for publication on the 1st February 2019.  

 

26.4.    Discussion took place around section 7.4 of the statement (appendix a) which referred to Councillors representing individuals views when requested on licensing applications. It was agreed that the wording be amended to read, “If individuals approach Councillors to ask them to represent their views and they accept, then these Councillors cannot be appointed as part of the Licensing & Regulatory Sub-Committee”.

 

 

Resolved:-

 

i.             that section 7.4 of the Statement of Principles 2019-2022 be amended to read “If individuals approach Councillors to ask them to represent their views and they accept, then these Councillors cannot be appointed as part of the Licensing & Regulatory Sub-Committee”.

 

ii.            that the draft “Gambling Act: Statement of Principles” as set out in Appendix 1 of this report be approved for the purposes of public consultation.

27.1.    Debbie Devine, Senior Licensing & Enforcement Officer, reported that the Local Government Association and National Anti-Fraud Network had implemented a National Register of Taxi (and private hire) Revocations and Refusals. All Local Authorities within England had been asked to confirm if they wished to contribute to the register.

 

27.2.    The Officer confirmed that the Council’s Data Protection Team had considered all guidance provided regarding the use of personal data and supported use of the register. 

 

27.3.    The Officer advised that having access to the register would ensure that the Licensing & Enforcement Team could confirm every applicant’s background with regards to any revocations/refusals for previous licences and provide an extra check to protect the public. 

 

27.4.    It was confirmed that a driver’s taxi licence and national insurance numbers would be included as part of the information held on the register. With regards to if an individual refused to have their data held, the Officer confirmed that drivers could submit a request that their information be withheld, and any determinations would be undertaken by the Data Protection Officer.

 

Resolved:

 

that the National Register of Taxi Licence Revocations and Refusals (NR3) and the Guidance produced by the LGA and NAFN attached as Appendix A to the report, be adopted.

28.1.    Discussion took place around the Station Hotel and the Temporary Event Notice which had been provided for the sale of alcohol from 6.00am on 2 September 2018 for the Football ‘Derby Day’. The Officer confirmed that all TEN applications would be approved unless there had been an objection from either the Police or Environmental Protection. In the event that an objection was lodged by either responsible authorities, then a Licensing & Regulatory Sub-Committee hearing would take place. On this occasion, no objections had been received and thus the TENs had been granted.

that the report be noted.
