The Council holds funds provided in accordance with a legal agreement made under Section 106 of the Town and Country Planning Act 1990 from the developers of the development at 7-11 Great Whip Street, which allows for the expenditure of these funds to be used for improvements to Dock Street. Suffolk County Council (SCC) is the Highway Authority and has applied to the Borough Council for the use of some of these funds to make highway improvements to Dock Street. The application is for funding of £102,411.87.
Following consultation with the Portfolio Holder for Environment & Transport on the application, including the proposed design, the Council has now decided to approve the application by SCC and transfer the above stated sum to SCC for them to carry out the improvements.
The design approach is acceptable and the use of funding is as specified. The alternative option would be to not to provide the funding.
The Council proposes to transfer the funding to SCC as they are the Highway Authority and the Borough Council does not have the power to implement the proposed scheme of highway improvements or contract with any other third party to do so. As such, it is considered that the Council can, in this case, only use this funding for this purpose with one ‘supplier’ and also that this is the most economically advantageous option.
To authorise the transfer to Suffolk County Council of £102,411.87 from the 7-11 Great Whip Street Section 106 (highways contribution) fund for a scheme of highway improvements on Dock Street, Ipswich.
