The Housing Act 1985 allows for purchasers of right to buy properties to request the Council’s consents to additional borrowing by agreeing to the postponement of priority of its discount Charge in favour of the advance.
The consent is given for approved purposes as defined in Section 156(4) (A) (c) (i) of the Housing Act 1985, the purpose being to enable the original purchaser to discharge the balance outstanding and arrears of interest (if applicable) on their original mortgage. The consent does not extend to any monies advanced for non-approved purposes.
An application has been received from an owner of a property (ref 19). Having reviewed the request in line with the above legislation the request is reasonable and there are no grounds for any alternative course of action.
There are no Crime & Disorder, Equality, Social Value, HR, Financial or ICT implications or implications for Council owned property.
